Visitation and Guest Policy

No other Guests are allowed to occupy the Premises without the Master Tenant’s and other Housemates written approval. It is prohibited for the Subtenant or Subtenant's guest to spend the night or sleep in the common areas of the Premisses. Master Tenant’s acceptance of rent from any other individual shall be deemed to be the payment of rent on behalf of the Subtenant's named above and shall not constitute permission for the person making the payment to occupy the Premises. Should any person not named above make any claim to right of possession of the Premises, any such person shall be deemed to be the guest or invitee of the named Subtenant and their claim to right of possession shall be denied. Any person named above in this Paragraph who is not also named above as a Subtenant and/or who is not a signatory to this Lease shall be deemed to be invitees of the named Subtenant, who is signatories to this Lease. Accordingly, if any such individual is not named in any unlawful detainer action to regain possession of the Premises, and if any such individual thereafter makes a claim to right of possession of the Premises, that claim shall be denied on the basis that said individual is the invitee of the named Suntenant and does not have an independent claim to right of possession of the Premises. Subtenant understands that in no event shall more than two persons per bedroom. If the household composition changes such that the number of occupants exceeds this occupancy standard, Subtenant agrees that such over-utilization shall be grounds for Master tenant to terminate this Agreement, solely at Master tenant’s option, to the extent allowed by applicable law.The Master Tenant has the right to unilaterally revise these provisions or generally House Rules at any time. Changes will be published on the website at the link hacknslep.com/guestpolicy. The Sub Tenant will be notified of such changes at his e-mail.
45.1. GUESTS: No guest may stay in or at the Premises for more than two (2) days, whether intermittent or successive, in any 12-month period. If Subtenant desires to add a person to this Agreement, Subtenant shall apply to Master tenant via email for a Change in Occupancy Addendum or Agreement. Whether or not the Master tenant approves a change in occupancy will depend upon the household size as of the time for application and the applicable occupancy standard and whether the proposed new occupant can meet the current rental criteria. Subtenant shall promptly notify Master tenant in writing via email of any incident of Subtenant guests' staying in or at the Premises for more than two (2) days, whether intermittent or successive, in any 12-month period.
45.2. With Master tenant's approval the Subtenant's guest can stay in or at the Premises for more than two (2) days, but not more than 14 days, whether intermittent or successive, in any 12-month period. In this case Subtenant has to pay base rent amount for his/her guest $100.00 per day (“Guest payment”). This Guest payment includes utilities and is due and payable on the Due Date without offsets, deductions or credits.
45.3. Subtenant agrees that Subtenant will sustain costs as a result of any late Guest payment and actual damage that would be sustained as a result of any Subtenant's guest actions. Subtenant agrees to pay a late charge equal to US $10.00 per day for any Guest payment not received by the Master tenant within 3 calendar days of the Due Date. The provision for payment of a late charge does not constitute a grace period.
